WHEREAS, the City Council, of the City of Decatur Alabama, finds and determines after a public hearing that the structure(s) on the below described lot(s) is in violation of the International Property Maintenance Code, as adopted by the City of Decatur; and

 

              WHEREAS, said violations constitute a public nuisance; and

              WHEREAS, said structure(s) is unsafe and said unsafe conditions should be removed to protect the public health and welfare of the citizens of Decatur; and

              WHEREAS, the owner(s) of record has been notified of said unsafe conditions in accordance with the International Property Maintenance Code, as adopted and amended by the City of Decatur; and

              WHEREAS, the owner(s) of record has been given the opportunity to abate said unsafe conditions and eliminate this public nuisance, yet has failed to do so;

 

              THEREFORE, BE IT RESOLVED by the City Council of the City of Decatur, in the State of Alabama, that the Mayor, Tab Bowling, is hereby authorized to abate said code violation(s) on the below described lot at City expense and the costs of such abatement shall constitute a lien on the property and shall be collected in a manner provided by law, and the Mayor is hereby authorized and directed to award any contract required for such abatement.

 

Said lot is described as follows

Legal Description:  Begin 160’ SE of the intersection of the N ROW of Moulton St. and the E ROW of 4th Ave. NW, then N 100’, then SE 110”, then S 100’, then W 110’ TPOB

              More commonly known as: 308 W. Moulton St. NW

Council President Ard opened the floor for comments from the public. Ray Uhrig, Attorney for the property owner requested council to delay this due not having time to interview the tenant who occupied the building and had obtained the permits to repair damage and bring up to code. He further stated the building had no outlived its useful life. City Attorney Herman Marks suggested it would be wise to give Attorney Uhrig an opportunity to address the issues presented this evening. Having no further comments he closed the public hearing.

Council Member Kirby motioned to table the Public Hearing. Council Member Jackson seconded. Council voted unanimously to delay the Public Hearing until 11/6/17

Council President Pro Tempore Ard opened the public hearing for comments.

Mr. Rodriguez owner of the property asked Council for a two week extension to evaluate the cost of repairs or demolition.

Having no further comments the Public Hearing was closed and then Council President Pro Tempore Ard entertained a motion from Council.

Council Member Bibbee motioned to table this item until the November 20th meeting. Council Member Hill seconded. All members of Council gave unanimous consent.

Council President Bibbee opened the public hearing for comments having none she then entertained a motion from Council.
